Last updated: October 11, 2025
This Privacy Policy describes how Injured Cases LLC, doing business as Settlement Compensation (“Settlement Compensation,” the “Company,” “we,” “us,” or “our”), collects, uses, discloses, retains, and otherwise processes personal information in connection with settlementcompensation.com and any website, landing page, form, questionnaire, advertisement, email, text message, or other communication that links or refers to this Privacy Policy (collectively, the “Site”), and in connection with the services offered through the Site, which consist of connecting consumers who have experienced motor vehicle accidents with independent attorneys and legal marketing companies that may be able to assist them (the “Services”). This Privacy Policy applies to information we collect on the Site; in email, text, and other electronic messages between you and the Company; when you interact with our advertising on third-party websites, applications, and social media platforms, where such advertising links to this Privacy Policy; and when you otherwise interact with us. It does not apply to information collected by any third party, including any participating attorney or legal marketing partner to which we provide your information, any advertising platform on which our advertisements appear, or any website, application, or content that may link to or be accessible from the Site, each of which is governed by its own privacy practices. By accessing or using the Site, or by submitting information through the Site, you acknowledge that you have read and understood this Privacy Policy and agree to the collection, use, and disclosure of your information as described herein. If you do not agree with our policies and practices, do not use the Site or submit information to us. This Privacy Policy is incorporated into and subject to our Terms of Use. The Company is not a law firm and does not evaluate or pre-screen your claim; we provide your information to a participating attorney or legal marketing partner so that it may contact you regarding potential legal assistance.
The Site and Services are intended for use solely by persons eighteen (18) years of age or older who reside in the United States. We do not knowingly collect personal information from, or direct the Site or our advertising to, individuals under the age of eighteen (18), and you should not provide us with any information regarding an individual under the age of eighteen (18). If we learn that we have collected personal information from a minor without verification of parental consent, we will delete that information. If you believe we may have any information from or about a minor, please contact us at [email protected]. The Site is operated from the United States and is not directed to individuals located outside the United States; if you access the Site from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your jurisdiction, and you consent to such transfer and processing.
We collect several categories of information from and about users of the Site, including personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household (“Personal Information”). Personal Information you provide to us directly includes your first and last name, telephone number, email address, postal address or ZIP code, and your responses to the questions presented in our questionnaire, which may include the date, location, and circumstances of the accident, the nature and extent of your injuries, whether you received or are receiving medical treatment, whether you were at fault, whether a police report was filed, and whether you have communicated with any insurance company, whether you have retained or consulted an attorney, and any other details you elect to provide that are relevant to a potential motor vehicle accident claim. We also collect records and copies of your correspondence with us, including email addresses and the content of communications, if you contact us. Certain of the information you provide, including information concerning your injuries and medical treatment, may constitute “sensitive personal information,” “sensitive data,” or “consumer health data” under applicable state privacy laws, and by providing such information you expressly consent to its collection, use, and disclosure as described in this Privacy Policy. You are not required to provide any information; however, if you elect not to provide the information requested, we will be unable to provide the Services to you.
We also collect information automatically as you navigate through and interact with the Site, including details of your visits to the Site, such as traffic data, location data, logs, the date and time of your visit, the pages and content you view, the links you click, the time spent on pages, and other communication data and the resources that you access and use on the Site; information about your computer, mobile device, and Internet connection, including your Internet Protocol (IP) address, device type and identifiers, operating system, browser type and language, screen resolution, and mobile carrier; approximate geographic location derived from your IP address; the website or advertisement from which you reached the Site (the “referring URL”); and campaign, advertisement, placement, and other tracking parameters contained in the URL through which you reached the Site (commonly known as UTM parameters). We may also receive information about you from third parties, including advertising platforms on which our advertisements appear (which may provide us with campaign performance data and audience information), data validation and verification services that confirm the accuracy of the telephone number, email address, or postal address you provided, and participating attorneys and legal marketing partners that may report to us whether a submission was received or was determined to be a duplicate, invalid, or fraudulent. We may combine information collected automatically or received from third parties with the Personal Information you provide.
The technologies we use for automatic data collection include cookies, which are small text files placed on your computer or mobile device by your browser that permit us and our service providers to recognize your device, remember your preferences, and analyze your use of the Site; web beacons, pixels, tags, and similar technologies, which are small electronic files embedded in web pages and emails that permit us and our service providers to count users who have visited a page or opened an email, measure the effectiveness of our advertising, and compile related statistics; embedded scripts, which are programming code designed to collect information about your interactions with the Site; and session recording and lead-certification technology, including TrustedForm by ActiveProspect, which records your interaction with the Site and the form you submit, including the consent language displayed to you, the position and state of any consent checkbox, the time and date of your submission, your IP address, and your device and browser information, in order to create a certificate documenting your consent that may be provided to the participating attorney or legal marketing partner that receives your information. We use the Meta Pixel and comparable advertising technologies offered by Meta Platforms, Inc., Google LLC, and other advertising platforms to measure the performance of our advertising, to build audiences for advertising, and to deliver advertisements to you on those platforms based on your interaction with the Site; information collected through these technologies is also collected by and subject to the privacy policies of those platforms. We may use web analytics services, including Google Analytics, that collect information about your use of the Site and report website trends; you may opt out of Google Analytics by installing the Google Analytics opt-out browser add-on available from Google. Certain content, advertisements, or applications on the Site may be served by third parties, including advertisers, ad networks and servers, content providers, and application providers, and these third parties may use cookies, web beacons, or other tracking technologies, alone or in conjunction with one another, to collect information about you when you use the Site, including information about your online activities over time and across different websites and online services, which they may use to provide you with interest-based advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. You may refuse to accept browser cookies by activating the appropriate setting on your browser, and most browsers permit you to delete cookies; however, if you select this setting, you may be unable to access certain parts of the Site, and certain features may not function properly. You may opt out of interest-based advertising from participating companies by visiting the opt-out pages of the Network Advertising Initiative (optout.networkadvertising.org) and the Digital Advertising Alliance (optout.aboutads.info), and you may adjust your advertising preferences directly with Meta, Google, and other platforms through their respective account settings. The Site does not currently respond to “Do Not Track” browser signals, for which no uniform industry standard has been adopted; recognized opt-out preference signals are addressed below.
We use the information we collect about you, or that you provide to us, including Personal Information, to present the Site and its contents to you; to provide you with the Services, including by providing your information to a participating attorney or legal marketing partner so that it may contact you regarding potential legal assistance; to document, verify, and maintain records of the consent you provided to be contacted; to respond to your inquiries and correspondence; to validate and verify the accuracy of the contact information you provide; to detect, investigate, and prevent fraudulent submissions, duplicate submissions, abuse, and other unlawful or harmful activity; to operate, maintain, secure, troubleshoot, and improve the Site; to measure, analyze, attribute, and optimize the performance and reach of our advertising campaigns; to create audiences for the delivery of our advertising on third-party platforms; to carry out our obligations and enforce our rights arising from any agreements between you and us; to comply with applicable laws, regulations, legal process, and governmental requests, and with the requirements of our participating attorneys and legal marketing partners; to develop aggregated, de-identified, or statistical data; to fulfill any other purpose for which you provide the information or that we describe to you at the time of collection; and for any other purpose with your consent.
Our business consists of generating consumer inquiries through advertising and providing those inquiries to participating attorneys and legal marketing partners in exchange for compensation. Accordingly, when you submit information through the Site, we disclose the information you provided, including your contact information and your responses to our questionnaire regarding your accident and injuries, together with the consent certificate and related technical information described above, to one participating attorney or legal marketing partner selected on the basis of factors such as your location, the type of claim, and participant availability. A legal marketing partner that receives your information may in turn provide it to a law firm with which it works. Such disclosure constitutes a “sale” of Personal Information and, where applicable, “sharing” of Personal Information for purposes of cross-context behavioral or targeted advertising, as those terms are defined under the California Consumer Privacy Act and other state privacy laws, and we are compensated for it. We do not provide your submission to more than one participating attorney or legal marketing partner, and we do not sell or share your information with data brokers or list compilers. Once your information has been disclosed to a participating attorney or legal marketing partner, its subsequent collection, use, retention, and disclosure are governed by that recipient’s own privacy practices and applicable rules of professional conduct, and not by this Privacy Policy, and we are not responsible for the privacy practices of any such recipient. By submitting a request for legal assistance, you consent to the recipient of your information conducting any research or verification it deems necessary to evaluate your request, which may include obtaining additional information about you from third-party sources.
We also disclose Personal Information to our affiliates and to service providers, contractors, and other third parties that perform services on our behalf and that are bound by contractual obligations to keep Personal Information confidential and to use it only for the purposes for which we disclose it to them, including providers of website hosting, customer relationship management and lead management software, lead certification and consent documentation, data validation, analytics, advertising measurement, email and text message delivery, and professional services such as legal and accounting; to advertising platforms, including Meta and Google, in connection with the measurement, attribution, and delivery of our advertising, including through the use of hashed or encoded identifiers; to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about users of the Site is among the assets transferred; to comply with any court order, law, or legal process, including responding to any government, regulatory, or law enforcement request; to enforce or apply our Terms of Use and other agreements; and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our participants, our users, or others, including exchanging information with other companies and organizations for the purposes of fraud protection. We may disclose aggregated, de-identified, or statistical information about users of the Site, and information that does not identify any individual, without restriction.
By submitting a form on the Site and checking the consent checkbox presented to you, you provide your electronic signature and your prior express written consent to be contacted by the parties identified in the consent language displayed at the time of submission, and by intake personnel acting on their behalf, at the telephone number and email address you provided, for the purpose of discussing your potential claim and related legal services, by telephone call, text message (SMS and MMS), and email, including calls and text messages made or sent using an automatic telephone dialing system, an artificial or prerecorded voice, or an artificial-intelligence-generated or synthetic voice, and regardless of whether your telephone number is listed on any federal, state, or company-specific Do Not Call registry or list. You represent that you are the subscriber or customary user of the telephone number you provided and that you are authorized to consent to receive communications at that number. Consent is not a condition of purchasing any goods or services or of retaining any attorney. You may revoke your consent at any time and by any reasonable means, including by replying STOP to any text message, by informing the caller that you no longer wish to be contacted, or by emailing [email protected] with your name and telephone number; upon receipt of a revocation, we will record it and forward it to the participating attorney or legal marketing partner that received your information. Revocation of consent will not affect communications already in progress or the lawfulness of communications made prior to revocation. Message frequency varies, and message and data rates may apply. If you no longer wish to receive promotional emails from us, you may follow the unsubscribe instructions contained in any such email or contact us at [email protected]; we may continue to send you transactional or administrative messages regarding your submission.
We retain Personal Information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide the Services, to maintain our business records, to comply with our legal, regulatory, tax, and accounting obligations, to resolve disputes, and to establish, exercise, or defend legal claims, and thereafter for such additional period as may be required or permitted by applicable law. Records evidencing your consent to be contacted, including the consent certificate and the consent language displayed to you, are retained for not less than the applicable statute of limitations for claims arising under the Telephone Consumer Protection Act and analogous state laws. When Personal Information is no longer required, we delete, de-identify, or aggregate it in accordance with our retention practices. We have implemented reasonable administrative, technical, and physical safeguards designed to protect Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure, including transmission of form submissions using encryption and restriction of access to Personal Information to personnel and service providers with a business need to access it. Unfortunately, the transmission of information via the Internet is not completely secure, and although we take reasonable measures to protect your Personal Information, we cannot guarantee the security of information transmitted to the Site; any transmission of Personal Information is at your own risk, and we are not responsible for circumvention of any privacy settings or security measures contained on the Site. The Site may contain links to third-party websites, including the websites of participating attorneys and advertising platforms, and any information you provide on those websites is provided directly to the operator of that website and is subject to that operator’s privacy policy; we are not responsible for the content or privacy practices of any third-party website.
Residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other states that have enacted comprehensive consumer privacy laws may have the following rights with respect to their Personal Information, subject to applicable exceptions, limitations, and verification requirements: the right to confirm whether we are processing their Personal Information and to access such information; the right to correct inaccuracies in their Personal Information; the right to delete Personal Information provided by or obtained about them; the right to obtain a copy of Personal Information they previously provided to us in a portable and, to the extent technically feasible, readily usable format; the right to opt out of the sale of Personal Information, the sharing or processing of Personal Information for purposes of targeted or cross-context behavioral advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects; the right to withdraw consent to the processing of sensitive Personal Information or consumer health data, and, where applicable, the right to limit the use of sensitive Personal Information; and the right not to be discriminated against or retaliated against for exercising any of these rights. To exercise any of these rights, including to opt out of the sale or sharing of your Personal Information, you may email [email protected] with the subject line “Privacy Request,” stating your name, the telephone number and email address you submitted, the state in which you reside, and the right you wish to exercise, or you may use the “Your Privacy Choices” link on the Site. We will verify your identity by matching the information you provide with the information associated with your submission and may request additional information reasonably necessary to verify your identity; we will not require you to create an account in order to submit a request. We will respond to verifiable requests within forty-five (45) days of receipt, or within such other period as applicable law requires, and may extend that period where reasonably necessary upon notice to you. Where we have already disclosed your Personal Information to a participating attorney or legal marketing partner before receiving your opt-out or deletion request, we will notify the recipient of your request to the extent required by applicable law. If we decline to take action on your request, we will inform you of the reason, and you may appeal our decision by replying to our response with the word “Appeal” in the subject line; within the period required by applicable law, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for our decision and, where applicable, information on how to contact the attorney general of your state. You may designate an authorized agent to submit a request on your behalf by providing the agent with written permission signed by you, and we may require the agent to provide proof of such authorization and may require you to verify your identity directly with us. We honor opt-out preference signals, including the Global Privacy Control, that are recognized under applicable law, and treat such a signal as a valid request to opt out of the sale and sharing of Personal Information associated with the browser or device from which the signal is sent.
